TERMS OF USE FOR HOME BUYERS AND SELLERS

CurrentListings.net allows Users to locate independent third party real estate professionals. Users (whether a home buyer or a home seller) agree to supply CurrentListings.net with information about themselves and the property they want to sell or hope to buy. CurrentListings.net will use this information within CurrentListings.net, and to provide certain details on an anonymous or non-anonymous basis depending on the CurrentListings.net service to third parties who are, in most cases, appropriate members of its real estate agent network. Users may also agree to have the information he/she has supplied to CurrentListings.net forwarded to real estate or other third-party professionals referred by CurrentListings.net. As CurrentListings.net uses email, on an almost exclusive basis, to provide CurrentListings.net services, all CurrentListings.net users must consent to receive Email from CurrentListings.net to register for CurrentListings.net services. CurrentListings.net users will also be required to consent to receive emails from third party(ies) if the CurrentListings.net service requested requires services from a third party(ies)(for example, a local real estate agent).

To assure the value of CurrentListings.net services, you agree that all of the information you have provided to CurrentListings.net, whether on line or otherwise, is accurate and complete. CurrentListings.net reserves its right to terminate or suspend access to any user information that is alleged to be inaccurate or misleading. If required by the terms of the CurrentListings.net service requested by User, you authorize CurrentListings.net to forward your information to its network of real estate professionals according to the terms of the CurrentListings.net service that you use.

CurrentListings.net may refer real estate professionals to Users, but CurrentListings.net does not engage in real estate broker services. Real Estate brokerage activities are performed by local Real Estate Professionals that have been referred to you by CurrentListings.net. The terms of any agreement between a real estate professional and CurrentListings.net are not endorsed, recommended or otherwise known to or by CurrentListings.net.

For its services CurrentListings.net may receive payment including, but not limited to a referral fee that may be a percentage of the commission received by the real estate professionals involved in the real estate transaction. CurrentListings.net payment is due an agreement between CurrentListings.net and the real estate professional involved. Your registration with CurrentListings.net and use of CurrentListings.net services constitutes your acknowledgment of, and agreement to, this compensation arrangement.

CurrentListings.net may from time to time offer eligible Users promotional opportunities to incent use of CurrentListings.net services within a particular time frame. These opportunities may include but are not limited to discounts, rebates, gift certificates, or other incentives that are only available to Users who use a CurrentListings.net affiliated real estate professional to buy or sell a home. User eligibly for a particular promotion will be defined in the terms of each promotion. Not all Users may be eligible to receive all promotional opportunities.
"Only a Forum"

The Sites and the services offered therein are provided solely as a forum and technical interface that connects homeowners with locally licensed real estate agents, brokers and other home-related service providers. We do not provide any real estate, appraisal or house-related services, and do not hold ourselves out as being licensed to perform any such services. We do not sponsor, endorse, recommend or approve of any real estate agent, broker or other home-related service provider who offers services through the Sites. You should use your independent judgment of the merits of any individual, entity or information that you find on or through the Sites. While we try to confirm that participating real estate agents, brokers and other home-related service providers are licensed to perform their respective services, we cannot and do not represent or warrant that any real estate agent, broker or other home-related service provider who offers services through the Sites is licensed, qualified, or capable of performing any such service.

It should also be noted that we do not make any assurance as to the timeliness or accuracy of information provided by any real estate agent, broker or other home-related service provider including any home evaluation, or other related follow up. Furthermore, if the requesting homeowner submits incomplete, insufficient or inaccurate information, or if the completion of a home evaluation is in conflict with real estate rules, laws or best practices, then an evaluation may not be provided to the requesting homeowner.

Use of Site

The Sites and all information and materials included in the Sites are only for your personal use. You will not use the Sites or any information or materials included in the Sites for commercial purposes. You will not use the Sites or any information or materials included in the Sites in any way that is unlawful, or harms Realty Resources LLC and/or its suppliers. Realty Resources LLC prohibits to the maximum extent allowable the resale, redistribution, and use of the information or materials included in the Sites for commercial purposes. You may not engage in the practices of "screen scraping," "database scraping," or any other activity with the purpose of obtaining lists of users or other information from the Sites. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Sites.

Responsibility for Your Conduct

You are solely liable for your conduct or any information that you upload or transmit to a Site. You may not provide false or misleading information to the Sites or submit information under false pretenses. Without limiting anything else in these Site Terms, we may immediately terminate your access to and use of any of the Sites if you provide false or misleading information or submit information under false pretenses. Each person that is provided with a password and user ID to use a Site must agree to abide by these Site Terms and is responsible for all activity under such user ID. You are responsible for maintaining the confidentiality of any password connected with your account.

Submissions

You agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, provided by you in the form of e-mail or submissions to us, or postings on the Sites, are non-confidential (subject to our Privacy Policy). We will own exclusive rights, including all intellectual property rights, and will be entitled to the unrestricted use of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

YOU EXPRESSLY AGREE THAT USE OF THE SITES AND THE MATERIALS IS AT YOUR SOLE RISK. REALTY RESOURCES LLC AND ITS SUPPLIERS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT AS TO THE SITES AND MATERIALS.

Termination

Applicable Law and Venue

These terms and conditions are governed by and construed in accordance with the laws of the State of Illinois, applicable to agreements made and entirely to be performed within the State of Illinois, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these terms and conditions can be filed only in state or federal court located in Chicago, IL and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these terms and conditions.

General Terms

If any part of the Site Terms is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Site Terms will continue in effect. We may assign this Agreement, in whole or in part, at any time with or without notice to you. You may not assign this Agreement, or assign, transfer or sublicense your rights, if any, in the Sites. Except as expressly stated herein, the Site Terms constitute the entire agreement between you and us with respect to the Sites.
